MRP Returns in September 2009
On July 21, 2009 the Sacramento Superior Court directed the Commission on State Mandates to reinstate the Mandate Reimbursement Process Statement of Decision and Parameters and Guidelines. Recall that the MRP program reimburses local government and educational agencies for the costs associated with tracking and filing annual mandated cost claims. There is no discussion on the CSM website concerning the retroactivity of this action. The Commission removed the MRP program in May of 2006 and arguably claimants should have the opportunity to claim prior-year costs as the Court held the State's actions should be considered "null and void." OMA Returns September 2009
Along with the MRP program, schools will soon be filing Open Meetings Act claims again. The Superior Court directed to the Commission on State Mandates to reinstate the OMA and Brown Act Reform Statements of Decision and Parameters and Guidelines. Similar to the MRP program, there is no discussion related to whether the Commission's actions will have a retroactive effect as the OMA/Brown Act Reform mandate was overturned in September 2005. SARC Returns September 2009
The final mandate program returning to the fold is the School Accountability Report Card program. The Commission on State Mandates is ordered to reinstate the SARC Statement of Decision and Parameters and Guidelines. Again, no retroactive application discussion is included with the documents listed on the Commission's website. The Commission overturned the SARC program in July 2005 and January 2006.
